• Keeping in view the report of the Law Commission of India and WHO, that states that 50% of road accident fatalities can be saved by providing basic life support and pre medical help at the earliest to the accident victims. Muskaan has built up an advocacy to protect the Good Samaritan who wants to help the accident victim but has always been hampered because of cumbersome procedures involved.This has delayed medical aid to the victim giving rise to deaths.
• In its judgement 30th March 2016 Supreme Court has issued directions to all states regarding Good Samaritan Guidelines making the procedure simple and encouraging for those wh wished to help. The NGO found that the guidelines were not followed by the Health and the Police Department.
• Meanehile Muskaan continued to generate awarness about Good Samaritan Guidelines through Road Safety Orientations to Police, Youth and Educational Institutes.
• As a member of the important committees, Muskaan made consistent representations to the High Power Committee and State Road Safety Council to generate awareness about Good Samaritan Guidelines. It insisted that the guidelines be followed to save accident victims. As a result the Home Department, Goverment of Rajasthan issued a notification dated April 22nd 2019 to the Health Department, Rajasthan. (Copy of notification to be included).
• As a result of our advocacy efforts Additional Director General of Police (Traffic) Rajasthan issued a circular to the Deputy Commissioners of Commissionerates of Jaipur and Jodhpur and the Supritendent of Police of all the districts of Rajasthan directing them to follow the supreme court guidelines for Good Samaritan.
• In November 2019, the Directorate of Health called a meeting of private hospitals of Jaipur to follow the Good Samaritan Guidelines.
• Muskaan will continue its advocacy till there is a system approach in place to the important issue.
